Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Lucky Nab website, marketplace, and warehouse pickup services (the “Services”) operated by CFCC LLC d/b/a Lucky Nab (“Lucky Nab,” “we,” “us,” or “our”). By creating an account, bidding, buying, or otherwise using the Services, you agree to these Terms.

1. Who we are

CFCC LLC d/b/a Lucky Nab, 1055 Starks Road, Cumberland Furnace, TN 37051. Lucky Nab is a pickup-centric retail liquidation marketplace. We list surplus, overstock, open-box, customer-return, refurbished, and mixed goods for item-level auction and, where offered, Buy It Now.

2. Eligibility and accounts

You must be at least 18 years old and able to form a binding contract. You are responsible for your account, password, saved payment method, and all bids and purchases made from the account. We may suspend or close accounts that violate these Terms, fail payment, or abuse pickup.

3. How sales work

Listings are invitations to bid or buy specific lots. A bid is an irrevocable offer. When an auction ends, the high bidder’s card on file is charged automatically and a pickup ticket is created. Buy It Now, where offered, charges the listed price and likewise creates a pickup ticket.

Starting prices, current bids, bid counts, and clocks are displayed on the lot page. We may extend, pause, correct, or cancel a listing for catalog error, duplicate listing, or operational need. Winning does not transfer title until the charge succeeds.

4. Pickup only

Lucky Nab is pickup-centric. Unless a listing expressly states that the lot ships, lots are warehouse pickup only. After a successful charge you receive a barcode. Show that barcode at the named warehouse during the published pickup window for that event.

You are responsible for transport, loading, and any helper you bring. Staff may refuse pickup that is unsafe, after hours, or without a valid ticket.

5. Dedicated pickup day and forfeiture

Each sold lot has a dedicated pickup day (or window) published with the event. If you miss that dedicated pickup day, the lot is forfeited. Forfeiture means you lose the goods and the purchase price. We do not owe a refund, store credit, or replacement date unless we cancel the sale ourselves.

Do not assume a later warehouse day, a staff courtesy hold, or an email to us preserves the lot. Missed dedicated pickup day = forfeiture.

6. As-is; no warranty; no returns

Every lot is sold as-is, where-is, with all faults. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title, quiet enjoyment, and non-infringement, to the fullest extent Tennessee law allows.

There are no returns, refunds, price adjustments, or exchanges. This includes New, Like New, Open Box, Customer Returns, Shelf Pulls, Salvage, Mixed, and Refurbished goods. A “refurbished” label is not a warranty and does not restore manufacturer coverage.

Inspect at pickup. If you complete pickup, you accept the lot in the condition delivered. Photographs and descriptions are for identification, not a guarantee of completeness, authenticity of extras, or cosmetic grade.

7. Pro buyers

Pallets and truckloads are Pro inventory. Pro access requires a completed application, a valid resale certificate (number, issuing state, and file), and our approval. Approval is not guaranteed and may be denied or revoked at any time.

Pro buyers represent that they buy for resale or other lawful wholesale use, and that their resale certificate is genuine and current. Retail customer accounts may not bid Pro lots.

8. Payments and taxes

By bidding or buying you authorize us (and our payment processor) to charge your saved payment method for the hammer or Buy It Now price, plus any disclosed fees and applicable sales tax. Failed or reversed charges may cancel the sale and the lot may be relisted. You are responsible for any tax not collected at checkout that later applies to the purchase or your resale.

9. Conduct

You may not manipulate bidding, use extra accounts to bid against yourself, scrape the site, interfere with warehouse operations, or remove goods that are not on your ticket. We may ban bidders and cooperate with law enforcement.

10. Limitation of liability

To the fullest extent permitted by law, CFCC LLC, its members, and workers are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, inventory, or data, arising from the Services or any lot.

Our total liability for a lot will not exceed the amount you actually paid us for that lot. Some rules in Tennessee may not allow certain disclaimers; those Terms apply only to the extent allowed.

11. Governing law

These Terms are governed by the laws of the State of Tennessee, without regard to conflict-of-law rules. Exclusive venue is the state and federal courts sitting in Dickson County, Tennessee.

12. Changes

We may update these Terms. The effective date above is the current version. Continued use after a posted change is acceptance of the new Terms. The lot you already won stays under the Terms in effect when you won it, except that pickup, as-is, and forfeiture rules still apply.
